1. ABOUT DRAKOS

Drakos is a combat sports brand offering apparel, equipment, and accessories designed for athletes, practitioners, teams, academies, gyms, and combat sports enthusiasts.

If Drakos cancels an order after payment has been received, any applicable refund will be issued in accordance with these Terms and applicable law.

Payment must be successfully authorized before an order is released for production or shipment, unless Drakos expressly agrees otherwise.

You represent that:

·        You are authorized to use the payment method provided.

·        The payment information you submit is accurate.

·        The transaction is legitimate and authorized by you.

Drakos may use third-party payment processors to securely process transactions.

We do not intentionally retain complete payment-card information where the payment processor handles that information.

9. CUSTOM AND MADE-TO-ORDER PRODUCTS

Drakos offers customized and made-to-order products.

Customization may include, depending on the product:

·        Custom designs.

·        Custom colors.

·        Custom sizing.

·        Color combinations.

·        Patches.

·        Sublimation.

·        Thread details.

·        Personalized branding.

·        Other approved customization options.

Customers are responsible for carefully reviewing the information they provide before production.

Once a customer has approved a final design, specifications, measurements, or customization details, production may begin.

Because customized products are created specifically for the customer, custom or made-to-order products are generally not eligible for return or refund due to change of mind, incorrect customer-provided information, preference changes, or dissatisfaction with a customization that was produced according to the approved specifications, except where required by applicable law or where the product is defective, materially incorrect, or otherwise eligible under our Return & Refund Policy.

If Drakos identifies a production issue before shipment, we may contact the customer to correct the issue before dispatch.

10. CUSTOMER-SUBMITTED DESIGNS AND CONTENT

If you submit logos, artwork, photographs, graphics, names, trademarks, text, or other materials for customization (“Customer Content”), you represent that:

·        You own the Customer Content or have permission to use it.

·        Your submission does not knowingly infringe another person's intellectual-property rights.

·        You have the necessary rights and permissions to authorize Drakos to use the Customer Content for fulfilling your order.

You retain ownership of your Customer Content.

By submitting Customer Content, you grant Drakos a limited license to use, reproduce, modify as necessary for production, and provide the content to our production partners solely for the purpose of fulfilling your order and providing related services.

Drakos may refuse customization requests that we reasonably believe are unlawful, infringing, fraudulent, hateful, threatening, abusive, or otherwise inappropriate.

11. SIZING AND FIT

Customers are responsible for selecting the appropriate size using the sizing information provided on the Site.

Where custom measurements are provided by the customer, the customer is responsible for providing accurate measurements.

Minor variations may occur due to manufacturing tolerances, fabric characteristics, or garment construction.

If a product has been manufactured according to the customer's approved specifications and measurements, a return or refund may not be available solely because the customer later determines that the selected size or fit is not preferred.

Where an incorrect size or specification is caused by a verified Drakos production error, the matter may qualify for replacement, correction, or another remedy under our Return & Refund Policy.

12. BULK AND TEAM ORDERS

Drakos may offer customized and bulk-order services for:

·        BJJ academies.

·        MMA gyms.

·        Combat sports clubs.

·        Martial arts schools.

·        Teams.

·        Coaches.

·        Organizations.

·        Events and competitions.

Bulk orders may be governed by additional quotations, invoices, production agreements, or written terms provided to the customer.

Where a separate written agreement applies to a bulk order, that agreement will govern the specific commercial terms of that order to the extent permitted by law.

Bulk and team orders may have different:

·        Minimum quantities.

·        Pricing.

·        Production timelines.

·        Payment requirements.

·        Design approval requirements.

·        Shipping arrangements.

·        Cancellation and refund conditions.

13. DESIGN APPROVAL

For customized or bulk products, Drakos may provide digital previews or 3D mockups for customer review.

Customers are responsible for reviewing approved designs carefully, including:

·        Spelling.

·        Names.

·        Numbers.

·        Logos.

·        Colors.

·        Placement.

·        Sizes.

·        Design elements.

·        Customization details.

Once a design has been approved for production, changes may not be possible.

Any requested changes after approval may result in additional costs or production delays.

14. SHIPPING AND DELIVERY

Drakos currently produces and ships orders through its production operations in Pakistan and ships to supported destinations worldwide.

Estimated delivery times may vary depending on destination, product type, customization, production requirements, courier operations, weekends, holidays, weather, customs processing, and other circumstances outside our reasonable control.

Unless a different timeframe is specifically stated for a product or order, international delivery after dispatch may typically take approximately 7–12 business days.

This is an estimate and not a guaranteed delivery period.

Tracking information will generally be provided after the order has been dispatched.

Customers are responsible for providing a complete and accurate shipping address and contact information.

15. SHIPPING DELAYS

Drakos makes reasonable efforts to meet stated production and shipping estimates.

However, delays may occur because of:

·        Customs clearance.

·        Import procedures.

·        Courier delays.

·        Weather.

·        Natural disasters.

·        Transportation interruptions.

·        Incorrect customer information.

·        Public holidays.

·        Unexpected production circumstances.

·        Other events outside our reasonable control.

If we become unable to ship an order within a legally applicable promised timeframe, we will provide any notice, revised timeframe, cancellation option, or refund required by applicable law.

16. CUSTOMS, DUTIES, AND IMPORT CHARGES

International orders may be subject to customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country.

Unless expressly stated otherwise, these charges are the customer's responsibility.

Drakos cannot guarantee that customs authorities will not delay or inspect an order.

Customers are responsible for complying with applicable import requirements in their country.

17. DELIVERY ISSUES

Customers should inspect their package and products promptly after delivery.

If an order arrives:

·        Incorrect.

·        Missing an item.

·        With a manufacturing defect.

18. RETURNS AND REFUNDS

Unless otherwise stated or required by applicable law, eligible standard products may be returned subject to the requirements stated in the Return & Refund Policy.

For customized, personalized, or made-to-order products, cancellation may become unavailable once production has started or once the customer has approved the design and production has commenced.

If an order cannot legally or reasonably be cancelled, the customer may still have rights relating to defective, incorrect, or non-conforming products.

20. PROMOTIONS, DISCOUNTS, AND OFFERS

From time to time, Drakos may offer promotional codes, discounts, launch offers, seasonal promotions, bundles, gifts, or other special offers.

Unless otherwise stated:

·        Promotions may have specific eligibility requirements.

·        Promotional codes may have expiration dates.

·        Some products may be excluded.

·        Promotions may not be combined.

·        A promotion cannot be applied retroactively to previous purchases.

22. COMBAT SPORTS AND PRODUCT SAFETY

Drakos products may be designed for training, competition, athletic, or general sporting use depending on the specific product.

Combat sports involve inherent risks, including physical injury.

Customers and athletes are responsible for:

·        Using products appropriately.

·        Following the rules of their sport.

·        Following instructions provided with the product.

·        Selecting appropriate protective equipment.

·        Training under appropriate supervision where necessary.

·        Inspecting equipment before use.

·        Discontinuing use of damaged or compromised equipment.

Drakos products are not a substitute for proper training, coaching, medical advice, safety equipment, or responsible athletic practice.

Unless expressly stated for a specific product, Drakos does not represent that every product is approved, certified, or permitted for every competition, federation, organization, or event.

Customers are responsible for checking the rules and equipment requirements of their relevant governing body or competition before using a product in competition.

23. PRODUCT USE AND LIABILITY

To the fullest extent permitted by applicable law, Drakos is not responsible for injuries, losses, or damages arising from:

·        Misuse or abuse of a product.

·        Use of damaged equipment.

·        Failure to follow product instructions.

·        Training or competition risks inherent to combat sports.

Nothing in these Terms is intended to deprive consumers of rights that cannot legally be waived under the laws applicable to them.

35. DISPUTES

If you have a concern regarding an order, product, or service, we encourage you to contact Drakos first so that we can attempt to resolve the matter directly.

Where permitted by applicable law, disputes that cannot be resolved informally may be brought before a court of competent jurisdiction.

Nothing in these Terms prevents a consumer from exercising rights or remedies that cannot legally be waived.

36. SEVERABILITY
